1. ASSISTANCE TO BOMB BLAST VICTIMS

(a): A Central Scheme is in operation with effect from 01.04.2008 for granting financial assistance of Rs. 3 lakh each to civilian victims of terrorist / communal violence in case of each death or permanent incapacitation to the next of kin (NOK) of the victims. Under this scheme, an amount of Rs. 84 lakh has been released to the victims of bomb blast in the National Capital Territory of Delhi as per details given below;

2. STATE HUMAN RIGHTS COMMISSION

(a) whether all the states have constituted the State Human Rights Commission;

(b) if so, the details thereof and if not, the reasons therefor, State-wise;

(c) the details of complaints received by each of the State Human Rights Commissions during each of the last three years and the current year, State-wise;

(d) the manpower and infrastructure currently in place under the existing Commissions,State-wise;

(e) the steps taken by the Government to strength the said Commissions; and

(f) the measures taken by the Union Government to ensure that Human Rights Commissions are constituted in all the States and for ensuring proper accountability of the States in matters of human rights violation alongwith the steps taken to fill up the vacant post of Chairman of State Human Rights Commission?

(b): The following States have constituted State Human Rights Commission:-

1. Assam 2. Andhra Pradesh 3. Chhattisgarh 4. Himachal Pradesh 5. Jammu & Kashmir 6. Kerala 7. Madhya Pradesh 8. Maharashtra 9. Manipur 10. Orissa 11. Punjab 12. Rajasthan 13. Tamil Nadu 14. Uttar Pradesh 15. West Bengal 16. Karnataka 17. Bihar 18. Gujarat 19. Sikkim.

The following nine States have not constituted the State Human Rights Commissions:-

1. Arunachal Pradesh 2. Goa 3. Haryana 4. Jharkhand 5. Meghalaya 6. Mizoram 7. Nagaland 8. Tripura 9. Uttarakhand.

(c) to (d): Information is being collected and shall be laid on the Table of the House.

(e) to (f): The Government of India and National Human Rights Commission are keen that every State sets up a State Human Rights Commission (SHRC). The Government and NHRC have been requesting to all those States which have not yet constituted their State Commission to do so at the earliest. The responsibility to strengthen the State Human Rights Commission, to fill up the post of Chairman of such commissions and to ensure accountability, lies primarily with the respective State Government.

3. SMUGGLING ACROSS BORDERS:

(a) & (b):Reports of smuggling of drugs and weapons from across Indo-Pakistan, Indo- Bangladesh, Indo-Nepal, Indo-Bhutan and Indo-Myanmar borders have been received. Details of the quantity of drugs and arms seized by the respective border guarding force on these borders during the last three years and the current year are annexed.

(c) & (d):No involvement of extremist elements has come to the notice.

(e):The Government have adopted a multi-pronged approach to contain illegal activities on the borders including smuggling which, inter-alia, includes round the clock surveillance & patrolling
on the borders and establishment of observation posts; construction of border fencing and flood lighting; introduction of modern and hi-tech surveillance equipment; upgradation of intelligence set up and coordination with the State Governments and concerned intelligence agencies.

4. CALAMITY RELIEF

(b) the details of complaints received from the State Governments regarding irregularities in utilisation of funds from Calamity Relief Fund (CRF) and National Calamity Contingency Fund (NCCF); and

(c) the action taken by the Government to check such irregularities including setting up of a monitoring system?
ANSWER

(a): A statement showing the State-wise details of allocation & releases of Central Share of Calamity Relief Fund (CRF) and financial assistance released from NCCF during the year 2009-10 is at Annexure.

(b): This Ministry has not received any complaint from State Governments regarding irregularities in utilization of funds from Calamity Relief Fund (CRF) and National Calamity Contingency Fund (NCCF).

(c): Does not arise.
As per the extant Scheme for Constitution and Administration of the CRF formulated by the Ministry of Finance based on the recommendations of the 12th Finance Commission, the expenditure from the CRF is to be incurred according to the approved items and norms. The Scheme provides that the Accounts of the Fund is to be maintained by the Accountant General in charge of accounts of the State. Comptroller and Auditor General of India would cause audit of CRF every year in terms of the purposes of the CRF Scheme.

In order to have improvement in the mechanism of the monitoring of relief expenditure, a web based computerized tracking system has been developed by the MHA

5. BIOMETRIC UNIQUE IDENTIFICATION CARD

(a) Whether the Government proposes to issue Biometric Unique Identification Cards to all the citizens in the country;

(b) If so, the details thereof including the purpose and utility sought to be achieved through such cards;

(c) Whether the Government has constituted any empowered group to oversee the implementation of this project;

(d) If so, the details thereof;

(e) Whether the Government has formulated any plan for the successful and foolproof implementation of the project; and

(f) if so, the details thereof including the source of the data to be utilized in the project and survey conducted for the purpose?

(a) to (f): A Pilot Project on Multi-purpose National Identify Card (MNIC) has been implemented in selected areas of 12 states and one union terriotory viz.,Andhra Pradesh, Assam, Delhi, Goa, Gujarat, Jammu and Kashmir, Rajasthan, Tripura, Uttar Pradesh, Uttarakhand, Tamil Nadu, West Bengal, and Puducherry, Under this project, data base has been created of 28.62 lakh persons. 12.88 lakh identity (smart) cards have bee issued to those of 18 years of age and above while the rest have been given a national identity number. The implementation of the Pilot Project has been closed on 31.3.2009.

Based on the experience of the Pilot Project, the Government has proposed to create a National Population Register (NPR) in the country along with 2011 Census. For the NPR, details on specific characteristics of each individual shall be collected along with photograph and finger biometrics of all those who are 18 years of age and above. However, the NPR for the coastal villages in 9 Maritime States of Gujarat, Maharashtra, Goa, Karnataka, Kerala,Tamil Nadu, Andhra Pradesh, Orissa and West Bengal and 4 Union Territories (UTs) of Daman & Diu, Lakshadweep,Andaman & Nicobar Islands and Puducherry, will be created during 2009-10. This decision has been made with a view to strengthen the security in coastal areas after 26/11 incident. The scheme has been approved for 3331 coastal villages to be covered in first phase. The remaining coastal areas including the towns/cities would be covered along with 2011 census.

The Scheme for coastal areas envisages identity cards to be given to all the usual residents who are 18 years of age and above. However, no such decision has been made for issuance of identity (smart) cards to the usual residents in the rest the country.

The Government has proposed to set up an Empowered Group which would oversee the Unique Identity Card Scheme. The composition of the Group will be known after it is formally constituted.
